hotelspot website terms of service
Rules for using the hotelspot website, the free hotel visibility audit and ordering the paid full SEO and AI audit.
This is a translation provided for convenience. The Polish version is the binding one.
§ 1. General provisions
These Terms set out the rules for using the hotelspot.pl website in its Polish, English and German versions (the "Website") and for concluding and performing contracts for services provided through the Website. They are the terms referred to in Article 8 of the Polish Act of 18 July 2002 on providing services by electronic means.
The service provider and seller is Spotstay Sp. z o.o., registered office: ul. Cystersów 13/6, 31-553 Kraków, Poland, entered in the Register of Entrepreneurs of the National Court Register (KRS) under no. 0001096818, NIP (tax ID): 6762665735, REGON: 528200240 (the "Provider"). Contact: kontakt@hotelspot.pl.
Definitions:
- User: any person using the Website.
- Client: a User who orders the Full audit.
- Consumer: a natural person entering into a transaction with the Provider that is not directly related to their business or profession.
- Sole trader with consumer rights: a natural person concluding a contract directly related to their business where the contract shows it is not of a professional nature for them (Article 38a of the Polish Consumer Rights Act).
- Free audit: the free check of an accommodation website described in § 5.
- Full audit: the paid service described in §§ 6 to 8, in the option chosen by the Client.
- Report: the result of the Free audit or the Full audit, provided online or as a PDF file.
These Terms do not cover the use of the hotelspot application by hotels (the hotel panel), which is governed by a separate agreement, or its use by hotel guests, which is governed by the Application terms.
§ 2. Services on the Website
Through the Website the Provider offers:
- access to the Website content (product information, knowledge base, blog, glossary),
- contact, demo booking and partner forms,
- a revenue calculator with the option to send the result by email,
- the Free audit,
- a newsletter, if the User consents to it,
- sale of the Full audit.
The services in items 1 to 5 are free of charge. The contract for them is concluded when the User starts using the service (e.g. submits a form) and ends when the service is performed, the page is closed or the User opts out. Users can unsubscribe from the newsletter at any time using the link in the message or by writing to the Provider.
§ 3. Technical requirements
To use the Website you need a device with internet access, an up-to-date web browser (e.g. Chrome, Firefox, Safari, Edge) with JavaScript enabled and, for services delivered by email, an active email address. A PDF reader is needed to open the Report.
Using the internet involves typical risks such as malware or phishing. The Provider uses an encrypted connection (HTTPS) and recommends keeping software up to date.
§ 4. Rules of use
- Users must use the Website in accordance with the law, good practice and these Terms. Providing unlawful content is prohibited.
- Users must provide true information in forms. A website submitted for an audit should belong to a property the User represents or be a publicly available website the User is entitled to analyse.
- Automated form submissions, circumventing submission limits and disrupting the Website are prohibited.
- The Provider may apply daily submission limits and temporarily block submissions that breach points 1 to 3.
§ 5. Free audit
The Free audit covers one website of an accommodation property. The Website checks selected SEO elements, page speed (PageSpeed), the property's presence in Google results and AI Overview, and the answers of the Gemini assistant to sample guest questions. A preliminary result is shown on the page and the PDF Report is sent to the email address provided.
The Free audit is available only for accommodation websites. The Provider may refuse to perform it if the website is unavailable, is a domain for sale, redirects to another domain or is not an accommodation website.
The result is indicative. It is based on data available at the time of the check from third-party services (including Google and AI assistants), which may change, and AI answers may differ with each query.
§ 6. Full audit: ordering and payment
The scope of each Full audit option, prices and delivery time are stated on the service page. Prices are net prices plus VAT at the applicable rate. The gross amount due is shown before the order is placed.
To place an order, the Client:
- chooses a Full audit option,
- provides the property details (selected from Google or entered manually) and confirms the list of pages to check,
- provides contact details and, if a company invoice is needed, invoice details,
- chooses a payment method, accepts these Terms and confirms the order.
The contract is concluded when the Provider confirms the order by email. The confirmation includes the order details, the price and a link to these Terms.
Payment methods:
- online payment via Stripe Payments Europe Ltd. (methods available on the payment page),
- bank transfer to the Provider's account (prepayment) within 7 days of placing the order. If payment is not received in time, the order may be cancelled.
The Provider issues an electronic invoice and sends it to the Client's email address.
§ 7. Full audit: delivery
Work starts once the payment is received and takes 2 to 4 business days, unless the service page states otherwise. The Report is provided online (link) and as a PDF file sent to the Client's email address.
One order covers one property and one domain. The scope (number of pages, AI assistants, competitors and other elements) follows the description of the option on the service page on the order date.
If the Client's website is unavailable or blocks the check, the Provider informs the Client and agrees the next steps: a new date, a different address or a refund.
§ 8. Nature of the Report and liability
The Report contains analysis and recommendations. The Provider does not guarantee specific search positions, mentions in AI assistants, website traffic or bookings, as these depend on third parties and on the Client's actions.
Towards Clients who are neither Consumers nor Sole traders with consumer rights, the Provider's contractual liability is limited to the fee paid and excludes lost profits. This limitation does not apply to damage caused intentionally.
The Website content and Reports are protected by copyright. The Client may use the Report for their own property, including sharing it with those implementing the recommendations (e.g. an agency or web developer). Resale or public distribution of the Report requires the Provider's consent.
§ 9. Complaints
Complaints about the Website and services can be sent to kontakt@hotelspot.pl. A complaint should include contact details, a description of the problem and the expected resolution. A complaint about the Full audit should include the order number given in the order confirmation.
The Provider responds within 14 days of receiving the complaint, to the email address it was sent from.
Consumers and Sole traders with consumer rights have the rights relating to non-conformity of the service with the contract provided for in the Polish Consumer Rights Act.
§ 10. Right of withdrawal
A Consumer or a Sole trader with consumer rights may withdraw from the Full audit contract without giving reasons within 14 days of its conclusion by sending a statement to the Provider's email address.
If the Client requested that the work start before the withdrawal period ends and the Provider has fully performed the service, the right of withdrawal does not apply, provided the Client was informed before the start that they would lose it. If the Client withdraws during performance, they pay for the part of the service performed up to that point.
Refunds are made within 14 days of receiving the statement, using the same method the Client used, unless the Client agrees otherwise.
§ 11. Personal data and cookies
Personal data processing is described in the Privacy policy and the use of cookies in the Cookie policy. Both are available on the Website.
§ 12. Out-of-court dispute resolution
Consumers may use out-of-court complaint and redress procedures, for example by contacting a local consumer ombudsman or the Trade Inspection authority in Poland, or the consumer protection body in their own country. Information is available on the website of the Polish Office of Competition and Consumer Protection (uokik.gov.pl).
§ 13. Final provisions
- The Provider may amend these Terms for important reasons, in particular changes in law, in the scope of services or in payment methods. Amendments do not apply to orders placed before the new version takes effect.
- Contracts are governed by Polish law. This choice does not deprive a Consumer of the protection granted by the law of their country of habitual residence.
- Disputes with Clients who are not Consumers are resolved by the court competent for the Provider's registered office.
- These Terms are available in Polish, English and German. In case of discrepancies, the Polish version prevails.
- These Terms are effective from 30 September 2026.
